Welcome to TagStack.io! These Terms of Service ("Terms") govern your access to and use of the TagStack website, services, and products (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service.
1. Your TagStack Account
Account Creation
To use certain features of the Service, you must create an account. By creating an account, you represent and warrant that:
- You are at least 18 years old and have the legal capacity to enter into these Terms
- You are a human. Accounts registered by "bots" or other automated methods for the purpose of account creation are not permitted
- You will provide accurate, current, and complete information during registration
- You will maintain and update your account information to keep it accurate and current
- You will not create more than one account for yourself
- You will not share your account credentials with others
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials (username and password)
- All activities that occur under your account
- Notifying us immediately at support@tagstack.io of any unauthorized access or security breach
TagStack will not be liable for any loss or damage arising from your failure to maintain account security.
Account Restrictions
You must not, in your use of the Service:
- Violate any applicable laws in your jurisdiction or in the European Union (including but not limited to data protection, privacy, or intellectual property laws)
- Use the Service for any illegal or unauthorized purpose
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
2. Plans, Pricing & Payment
Available Plans
TagStack offers the following subscription plans:
Free Plan (€0/month):
- 5 private scans
- 1 saved scan
- 25 MCP (Model Context Protocol) messages per month
- 0 API requests
- Unlimited technology lookups
- AI code explainer
- No lead exports
- No GTM container exports
Starter Plan (€49/month):
- Unlimited scans
- 10 saved scans
- 150 API/MCP requests per month (shared quota)
- Unlimited technology lookups
- GTM container exports
- AI code explainer
- No lead list exports
Freelancer Plan (€149/month):
- Unlimited scans
- 100 saved scans
- 500 API/MCP requests per month (shared quota)
- Unlimited lead list exports (up to 20,000 leads per export)
- Unlimited technology lookups
- GTM container exports
- AI code explainer
Agency Plan (€349/month):
- Unlimited scans
- 2,000 saved scans
- 2,000 API/MCP requests per month (shared quota)
- Unlimited lead list exports (up to 100,000 records per export)
- Unlimited technology lookups
- GTM container exports
- AI code explainer
- Team member invitations
Payment Terms
By subscribing to a paid plan, you agree to pay TagStack the monthly subscription fees indicated for that plan. Payment terms:
- Prepaid Billing: Payments are charged on a prepaid basis on the day you upgrade to a paid plan and will cover the use of that plan for a monthly subscription period
- Payment Method: All payments are processed securely through Stripe, our payment processor. We do not store your credit card information
- Currency: All prices are in Euros (€)
- Taxes: Prices do not include applicable taxes. You are responsible for all sales, use, value-added (VAT), and other taxes associated with your subscription
- Fraud Prevention: To prevent fraud, we may temporarily disable your account after an upgrade to perform manual verification
Automatic Renewal
Unless you cancel your subscription before the end of your current billing period, your subscription will automatically renew for successive monthly periods. You authorize us to charge the then-current subscription fee (plus any applicable taxes) to your payment method on file.
To cancel your subscription:
- Cancel at least 24 hours before your next billing date
- Cancellation can be done via your account dashboard or by emailing support@tagstack.io
- Cancellation takes effect at the end of your current billing period
Refund Policy
Starter Plan (€49/month): All subscription fees are non-refundable. You will not receive a refund or credit for partial months of service, unused features, or cancellation for any reason.
Freelancer Plan (€149/month) and Agency Plan (€349/month): We offer a 30-day money-back guarantee. If you are not satisfied with your subscription, you may request a full refund within 30 days of your initial purchase by emailing support@tagstack.io. This guarantee applies only to:
- Your first payment for a new subscription to the Freelancer or Agency plan
- Not to renewal payments
- Not to upgrades from a previously active paid plan
After the 30-day period, all fees become non-refundable.
No Refunds For:
- Partial months of service
- Unused API/MCP requests
- Unused scan credits or saved scans
- Renewals or subsequent billing cycles
- Accounts terminated by TagStack for Terms violations
If you cancel your paid subscription (without requesting a refund), you will retain access to paid features until the end of your current billing period, after which your account will revert to the Free plan.
Changes to Pricing
TagStack reserves the right to change subscription fees upon thirty (30) days prior written notice to you. Price changes will take effect at the start of your next billing cycle after the notice period. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.
3. API and MCP Usage
API Access
API access is included in paid plans (Starter, Freelancer, and Agency) as specified. Free plan users do not have API access.
Shared API/MCP Quota
For paid plans, your monthly quota is shared between API requests and MCP (Model Context Protocol) messages. You may allocate your quota however you choose:
- Use it entirely for API requests
- Use it entirely for MCP messages
- Mix API and MCP usage in any proportion
Example: If you have the Freelancer plan with 500 requests/month, you could use 300 API requests and 200 MCP messages, or any other combination totaling 500.
Legitimate Automation
You may use automated tools, scripts, or bots to access the Service via the API once you have a valid account. However, you must:
- Stay within your plan's rate limits and monthly quotas
- Not use the API in a manner that could disable, overburden, or impair the Service
- Not use the API to build a competing service or product
- Not share your API credentials with unauthorized third parties
Rate Limiting and Abuse
TagStack monitors API usage to ensure fair use and system stability. We may:
- Implement rate limits to prevent abuse
- Temporarily or permanently suspend API access if we detect abusive behavior
- Throttle requests that exceed reasonable usage patterns
Abusive behavior includes but is not limited to:
- Attempting to circumvent rate limits or quotas
- Making excessive requests in a short time period
- Using the API in a manner that negatively impacts other users
- Using the API for illegal purposes or to violate third-party rights
4. Your Data and Our Data Rights
You Own Your Data
You retain all ownership rights to the data you submit to TagStack, including:
- Website URLs you scan
- Scan results and analytics
- Lead lists you generate
- Any other content you upload or create
Your Scan Data is Private
TagStack treats your scan data as confidential. Your specific scan results are private to your account.
We DO NOT:
- Sell your scan data to third parties
- Share your specific scan results with other TagStack users
- Use your scans to market to your competitors
- Make your client or website data publicly available
How We Use Your Data
We process your data solely to provide and improve the TagStack Service. Specifically, we may:
Provide the Service: Process your scan data to deliver the features you've requested (scans, exports, API responses, MCP interactions)
Improve the Service: Use aggregated, anonymized analytics to improve TagStack functionality
- Example: "40% of scans detect Google Analytics" (no identification of specific users or websites)
- We may analyze usage patterns to optimize performance and features
Technical Operations: Store, backup, and secure your data on our infrastructure (Cloudflare)
Support: Access your account data when you request customer support to resolve issues
Compliance: Process and retain data as required by applicable laws and regulations
License You Grant to Us
By using the Service, you grant TagStack a limited, worldwide, non-exclusive license to:
- Host, store, and process your submitted data
- Use aggregated, anonymized data for analytics and service improvement
- Display your company name and logo as a TagStack customer (you may opt out by emailing support@tagstack.io)
This license terminates when you delete your data or close your account, except for data we must retain for legal or regulatory compliance.
Your Responsibilities
You represent and warrant that:
- You have all necessary rights and permissions to submit data to TagStack
- Your use of the Service does not violate any laws or third-party rights
- You will not submit false, misleading, or inaccurate data
- You will not scan websites without authorization where such scanning may violate applicable laws
5. Data Privacy, Security & GDPR
Our Commitment to Privacy
TagStack is committed to protecting your personal data and complying with the EU General Data Protection Regulation (GDPR) and other applicable data protection laws.
Data Processing
- For your account data: TagStack acts as a Data Controller
- For data you import/scan: TagStack acts as a Data Processor, and you are the Data Controller

Data Processing Agreement
Our Data Processing Agreement (DPA) is incorporated into these Terms by reference and can be found at [tagstack.io/dpa]. The DPA outlines our commitments regarding data security, sub-processors, and your rights under GDPR.
Sub-Processors
TagStack uses the following trusted third-party service providers to deliver the Service:
- Cloudflare: Hosting, infrastructure, and databases (user data stored in Cloudflare D1)
- Cloudflare Zaraz: Tag management system
- Stripe: Payment processing
- Google Analytics 4: Website analytics
- Crisp.chat: Customer support and chat
- Brevo: Email communications
- Anthropic (Claude): AI processing for MCP features (when you use MCP)
An up-to-date list of sub-processors is maintained in our Data Processing Agreement.
Data Location
Your data is stored on servers located within the European Union (Cloudflare infrastructure). We ensure appropriate safeguards are in place for any data transfers outside the EU.
Your Rights Under GDPR
You have the right to:
- Access your personal data
- Rectify inaccurate data
- Request deletion of your data (right to be forgotten)
- Restrict or object to processing
- Data portability (receive your data in a structured, machine-readable format)
- Withdraw consent at any time
- Lodge a complaint with a supervisory authority

Data Retention
- Active accounts: We retain your data for as long as your account is active
- Deleted accounts: Upon account deletion, your data is removed within 30 days, except for data we must retain for legal, tax, or regulatory compliance (typically 6-7 years for billing records)
- Inactive free accounts: Accounts with no activity for 12 months may be deactivated, and data may be deleted
6. Acceptable Use Policy
You agree not to use the Service to:
Prohibited Activities
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights of TagStack or third parties
- Transmit viruses, malware, or other malicious code
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Use the Service to send spam, unsolicited communications, or phishing attempts
- Harvest or collect data from the Service using automated means (except via the API as authorized)
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or modify any copyright, trademark, or proprietary notices
- Use the Service to build a competing product or service
- Resell, redistribute, or sublicense the Service without our written permission
- Share your account credentials or allow unauthorized access to your account
- Create multiple accounts to circumvent usage limits or restrictions
Scanning Restrictions
When using TagStack's scanning features:
- Only scan websites you own or have explicit permission to scan
- Respect robots.txt files and other technical restrictions
- Do not use scanning to identify vulnerabilities for malicious purposes
- Comply with all applicable computer fraud and abuse laws
Consequences of Violation
If we determine that you have violated this Acceptable Use Policy or any other provision of these Terms, we may:
- Warn you and request that you cease the prohibited activity
- Temporarily suspend your account
- Permanently terminate your account without refund
- Report illegal activities to law enforcement authorities
- Take legal action to protect our rights and those of other users
7. Intellectual Property Rights
TagStack Ownership
TagStack and its licensors own all rights, title, and interest in and to the Service, including:
- The TagStack website, software, and technology
- The TagStack name, logo, trademarks, and service marks
- All design elements, features, and functionality
- Algorithms, methodologies, and know-how used to provide the Service
- Aggregated, anonymized analytics and insights derived from usage data
These Terms do not grant you any ownership rights to the Service or any TagStack intellectual property.
Your License to Use
Subject to your compliance with these Terms, TagStack grants you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the Service for your personal or internal business purposes
- Use the API in accordance with your plan limits
- Export and use data generated from your scans
This license does not permit you to:
- Create derivative works based on the Service
- Resell or redistribute the Service or any data obtained from it
- Use TagStack's trademarks or branding without permission
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant TagStack a perpetual, worldwide, royalty-free license to use, modify, and incorporate such feedback into the Service without any obligation to you.
8. Third-Party Services and Links
The Service may contain links to third-party websites or integrate with third-party services. TagStack:
- Does not control or endorse these third-party services
- Is not responsible for their content, privacy practices, or terms
- Makes no warranties regarding the availability or accuracy of third-party services
Your use of third-party services is at your own risk and subject to their respective terms and policies.
9. Service Availability and Modifications
"As Is" Service
The Service is provided on an "as is" and "as available" basis. While we strive for high availability and reliability:
- We do not guarantee uninterrupted or error-free service
- We do not guarantee specific uptime percentages (except as may be specified in separate Service Level Agreements for Enterprise customers)
- We may experience downtime for maintenance, updates, or technical issues
Right to Modify
TagStack reserves the right to:
- Modify, update, or discontinue any feature or functionality of the Service
- Change the scope, pricing, or terms of any plan
- Impose new limits or restrictions on usage
- Perform scheduled or emergency maintenance
We will provide reasonable notice of material changes when possible, but we are not obligated to maintain any specific feature indefinitely.
Beta Features
From time to time, we may offer beta, preview, or experimental features. These features:
- Are provided "as is" without warranties
- May be unstable or incomplete
- May be modified or discontinued at any time without notice
- Should not be relied upon for production or critical use cases
10. Customer Support
Support Channels
TagStack provides customer support via:

- Live chat: Available through Crisp.chat on our website (for paid plans)
- Help documentation: Available at tagstack.io/help
Response Times
Support response times vary by plan:
- Free plan: Best effort support, typically within 3-5 business days
- Starter plan: Response within 48-72 hours during business days
- Freelancer plan: Response within 24-48 hours during business days
- Agency plan: Priority support with response within 12-24 hours during business days
Response times are targets, not guarantees. Complex issues may require additional time to resolve.
Support Scope
Customer support covers:
- Account and billing questions
- Technical issues with the Service
- Feature questions and guidance
Customer support does not include:
- Custom development or integration work
- Training or consulting services (available separately)
- Issues caused by third-party services or your own systems
11. Account Cancellation and Termination
Your Right to Cancel
You may cancel your subscription at any time by:
- Using the cancellation option in your account dashboard, or
- Emailing support@tagstack.io
Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that time. No refunds will be provided for partial months or unused features.
Termination by TagStack
We may suspend or terminate your account immediately if:
- You violate these Terms or our Acceptable Use Policy
- Your account is involved in fraudulent activity
- You fail to pay fees when due (for paid accounts)
- We are required to do so by law
- Your use of the Service poses a security or legal risk
Effect of Termination
Upon termination or cancellation:
- Your access to the Service will be disabled
- You will no longer be able to access your data through the Service
- Your data will be deleted within 30 days (except for data we must retain for legal compliance)
- You remain responsible for all fees incurred prior to termination
Data Export
Before canceling your account, you should export any data you wish to retain. TagStack is not responsible for data loss resulting from account cancellation or termination.
12. Disclaimers and Warranties
IMPORTANT: Please read this section carefully. It limits TagStack's liability to you.
No Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, timely, secure, or error-free
- Warranties regarding the accuracy, reliability, or completeness of scan results or data
- Warranties that defects will be corrected
- Warranties regarding third-party services or integrations
No Guarantee of Results
TagStack provides tools for scanning and analyzing websites, but:
- We do not guarantee the accuracy or completeness of scan results
- We are not responsible for decisions you make based on data from the Service
- Scan results may be affected by website configurations, access restrictions, or technical limitations
- We do not guarantee that our Service will detect all tags, scripts, or technologies on a website
Your Responsibility
You are solely responsible for:
- Evaluating the accuracy and usefulness of the Service for your needs
- Verifying scan results before taking action based on them
- Ensuring compliance with applicable laws in your use of the Service
Some jurisdictions do not allow the exclusion of implied warranties. In such cases, the above disclaimers may not fully apply to you, and warranties will be limited to the fullest extent permitted by law.
13. Limitation of Liability
IMPORTANT: This section limits the damages you can recover from TagStack.
Limitation of Damages
TO THE FULLEST EXTENT PERMITTED BY LAW, TAGSTACK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Cost of substitute services
- Business interruption or loss of goodwill
- Any damages arising from your use or inability to use the Service
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if TagStack has been advised of the possibility of such damages.
Cap on Liability
In no event shall TagStack's total liability to you for all claims arising from or related to the Service exceed the greater of:
- €100, or
- The total amount you paid to TagStack in the 12 months preceding the claim
Exceptions
The limitations in this section do not apply to:
- Liability for death or personal injury caused by our negligence
- Liability for fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded under applicable law
14. Indemnification
You agree to indemnify, defend, and hold harmless TagStack and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any laws or regulations
- Your violation of any third-party rights, including intellectual property, privacy, or data protection rights
- Any data you submit to the Service
- Any claims made by third parties arising from your use of scan data or lead lists
TagStack reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.
15. Dispute Resolution and Governing Law
Informal Resolution
Before filing a formal legal claim, you agree to contact us at legal@tagstack.io to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.
Governing Law
These Terms and any disputes arising from or related to the Service shall be governed by the laws of France, without regard to conflict of law principles.
Jurisdiction
Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts located in Paris, France. You consent to the personal jurisdiction of these courts.
European Union Rights
If you are a consumer in the European Union, you may also have the right to bring proceedings in the courts of the EU country in which you reside. Nothing in these Terms affects your statutory rights as a consumer under applicable EU law.
16. Changes to These Terms
TagStack may update these Terms from time to time. When we make changes:
Material Changes
For material changes, we will:
- Provide at least 30 days advance notice via email to the address on your account
- Update the "Last Updated" date at the top of these Terms
- Post the updated Terms on our website
Minor Changes
For minor, non-material changes (such as clarifications or corrections), we will:
- Update the "Last Updated" date
- Post the updated Terms without separate notice
Your Acceptance
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your account.
17. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and TagStack regarding the Service and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by TagStack.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. TagStack may assign these Terms or any rights hereunder without your consent, including in connection with a merger, acquisition, or sale of assets.
Relationship of Parties
You and TagStack are independent contractors. These Terms do not create any partnership, joint venture, employment, or agency relationship.
Force Majeure
TagStack is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, strikes, internet or telecommunications failures, or government actions.
Survival
Provisions that by their nature should survive termination shall survive, including Sections 4 (Data Rights), 7 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), and 17 (General Provisions).
Language
These Terms are drafted in English. Any translation is provided for convenience only. In the event of any conflict between the English version and a translation, the English version shall prevail.
